Terms of Service

§ 1. General Provisions

  1. These Terms of Service ('Regulations') define the rules for using the services provided by Nexus Leadership Partners GmbH, with its registered office at Kurfürstendamm 213, 10719 Berlin, Germany ('Service Provider').
  2. These Regulations apply to all services offered by the Service Provider, including consultancy, training workshops, and executive coaching, whether delivered online or in person.
  3. By engaging the services of the Service Provider, the client ('User') confirms that they have read, understood, and agree to be bound by these Regulations.
  4. Matters not covered by these Regulations shall be governed by the applicable laws of the Federal Republic of Germany.

§ 2. Definitions

  • Platform – The online presence of the Service Provider, accessible at www.nexusleadership.de, used for information and communication purposes.
  • User – A legal entity, organizational unit, or individual entrepreneur who enters into a service agreement with the Service Provider.
  • Account – A client record maintained by the Service Provider for the purpose of service delivery and communication.
  • Services – All consulting, training, coaching, and related services provided by Nexus Leadership Partners GmbH as detailed in a specific service agreement.
  • Regulations – This document, the Terms of Service, which constitutes the agreement between the User and the Service Provider.

§ 3. Type and Scope of Services Provided

  1. The Service Provider offers specialized consulting and training services in the fields of leadership development, corporate culture, and organizational strategy. The specific scope, schedule, and fees for Services are defined in a separate written agreement or proposal agreed upon by both parties.
  2. All intellectual property, including course materials, methodologies, and tools, provided during the Services remains the exclusive property of the Service Provider. Users are granted a limited, non-transferable license for internal use only.
  3. The Service Provider reserves the right to make changes to program content and facilitators, provided that the quality and objectives of the service are not materially diminished.
  4. Services may be delivered in person, virtually, or in a hybrid format, as agreed upon in the service agreement. The User is responsible for ensuring participants have the necessary environment and technology for virtual sessions.

§ 4. Technical Requirements

  1. For virtual Services, the User must ensure participants have access to a stable internet connection, a computer with a modern web browser, and a functioning webcam and microphone.
  2. The Service Provider is not responsible for technical issues originating from the User's network or hardware.
  3. The Platform is optimized for current versions of major web browsers such as Chrome, Firefox, Safari, and Edge.

§ 5. Rights and Obligations of the User

  1. The User agrees to provide the Service Provider with all necessary information and cooperation required for the successful delivery of the Services.
  2. The User is obligated to make payments for the Services in accordance with the terms specified in the service agreement or invoice.
  3. The User agrees to ensure that all participants adhere to a professional code of conduct during all sessions. The Service Provider reserves the right to remove any participant who is disruptive without any refund.
  4. Confidential information shared by the Service Provider must be protected by the User and not disclosed to third parties without prior written consent.
  5. Cancellation or rescheduling of Services by the User is subject to the cancellation policy outlined in the specific service agreement.

§ 6. Final Provisions

  1. The Service Provider reserves the right to amend these Regulations. Users will be notified of any significant changes. Continued use of the Services after such notification constitutes acceptance of the new Regulations.
  2. Any disputes arising from the implementation of the service agreement shall be resolved amicably. If no agreement can be reached, the dispute will be settled by the competent court for the Service Provider's registered office.
  3. These Regulations are effective as of the date of their publication on the Platform.
